As the event industry evolves, so do the expectations of venues when it comes to liability protection.  One of the newest insurance requirements we are seeing is Sexual Abuse and Molestation (SAM) coverage.  

SAM coverage is a specific insurance endorsement that provides defense and potential settlement funds in the event of allegations related to sexual misconduct that takes place at an event.  This includes claims involving minors, staff, volunteers, or guests.

While this may seem like a worst-case scenario that “would never happen” at your event, it's precisely that mindset that has led many venues and risk managers to take a more proactive stance.

Why Venues/Entities Require SAM Coverage

In today’s litigious environment, venues are increasingly focused on protecting themselves from potential third-party liability.  SAM coverage has become a standard part of that equation (particularly for government entities and events involving minors).

1. Broader Public Awareness and Legal Action

High-profile cases and the increasing willingness of victims to come forward have made sexual misconduct claims more visible along with some very large financial payouts.  Venues don’t want to be caught in the crossfire of a lawsuit if an incident occurs during an event on their premises.

2. Risk Transfer

If an incident occurs, and the event organizer doesn’t have SAM coverage, venues can be held responsible and dragged into a lawsuit even if they weren’t directly involved with the act. Requiring SAM coverage helps transfer the risk away from the venue and ensures that the event organizer has the proper resources to defend against or settle a claim.

3. Working with Minors or Vulnerable Populations

Events involving children, such as school dances, recitals, retreats, or sports events, are considered higher-risk.  Risk management experts are actively advising their clients to require proof of SAM coverage if minors are attending or participating.
